Because most of the products available through our marketplace are delivered digitally and instantly, our refund policy differs from traditional retail stores.

By purchasing from Swirls Agency, you acknowledge that you have read and agree to this Refund & Returns Policy.

2. Digital Products

Because digital products are delivered immediately after payment and cannot be “returned,” all digital product sales are generally final.

Refund requests may be approved when:

  • You accidentally purchased the same product more than once.

  • You were charged multiple times for the same order.

  • The product cannot be downloaded due to an issue with our platform.

  • The files are corrupted or incomplete and cannot be replaced.

  • The product is materially different from its published description.

  • A verified technical issue prevents the product from functioning as advertised, and our support team cannot provide a solution within a reasonable timeframe.

Refunds are generally not available for:

  • Change of mind

  • Accidental purchases

3. Software Licenses

Purchasing a product grants the license described on the product page.

Unless specifically stated otherwise:

  • Ownership of the intellectual property is not transferred.

  • Licenses are non-transferable.

  • Products may not be redistributed, resold, shared, or repackaged without written permission from the copyright owner.

Violation of licensing terms may result in suspension of your account and termination of product licenses without refund.

Swirls Agency also provides professional services, including:

  • Marketing Services

  • API Integrations

  • Custom Software Development

  • Technical Support

  • Training & Implementation

Because these services involve reserved development time and custom work:

  • Deposits are non-refundable once work has begun.

  • Payments for completed work are non-refundable.

  • Milestone payments are considered earned upon completion of the agreed milestone.

  • If a project is canceled before work begins, a full refund may be issued.

  • If a project is canceled after work has started, any refund will be determined based on work completed and expenses incurred.


5. SaaS Products & Subscriptions

Some products offered through Swirls Agency operate on a subscription basis.

Unless otherwise stated:

  • You may cancel your subscription at any time.

  • Cancellation prevents future billing.

  • Previous subscription payments are non-refundable.

  • Access continues through the end of your current billing period unless otherwise specified.

Free trials, if offered, automatically convert to paid subscriptions unless canceled before the trial ends.


6. Marketplace Vendor Products

Swirls Agency operates a multi-vendor marketplace where independent creators may sell their own products and services.

Each vendor is responsible for:

  • Product quality

  • Product accuracy

  • Licensing

  • Updates

  • Documentation

  • Customer support

  • Their individual refund policy (if different)

Swirls Agency reviews refund requests involving marketplace vendors and may assist in resolving disputes. However, Swirls Agency cannot guarantee refunds for products sold by independent vendors unless required by law or otherwise stated.

If a vendor becomes inactive, repeatedly violates marketplace standards, or fails to provide reasonable support, Swirls Agency reserves the right to intervene and determine an appropriate resolution.


7. Physical Products

If physical merchandise is sold through the marketplace:

  • Returns must be requested within 30 days of delivery.

  • Items must be unused and in their original packaging.

  • Proof of purchase is required.

  • Customers are responsible for return shipping unless the item arrived damaged or incorrect.

The following items are not eligible for return:

  • Gift Cards

  • Downloaded Digital Products

  • Customized Products

  • Personalized Items

  • Opened Software

  • Products marked as Final Sale


8. Defective or Incorrect Products

If you receive:

  • the wrong product,

  • missing files,

  • corrupted downloads,

  • defective software,

  • a damaged physical item,

please contact us within 7 days of purchase or delivery.

We will make reasonable efforts to:

  • replace files,

  • repair technical issues,

  • provide updated downloads,

  • replace damaged products,

  • or issue a refund if the issue cannot reasonably be resolved.


9. Refund Processing

Approved refunds will be issued to the original payment method whenever possible.

Please allow approximately 5–10 business days after approval for your financial institution or payment provider to process the refund.


10. Chargebacks

We encourage customers to contact us before initiating a payment dispute or chargeback.

Fraudulent or abusive chargebacks may result in:

  • account suspension,

  • cancellation of licenses,

  • removal of marketplace access,

  • termination of future purchasing privileges.

Nothing in this section limits any rights you may have under applicable consumer protection laws.


11. Fraud Prevention

To protect our customers and marketplace vendors, Swirls Agency reserves the right to:

  • verify customer identity,

  • review suspicious orders,

  • delay fulfillment while payment verification is completed,

  • cancel orders suspected of fraud,

  • refuse service where fraudulent activity is reasonably suspected.


12. Vendor Responsibility

Marketplace vendors remain solely responsible for:

  • maintaining accurate product descriptions,

  • honoring advertised features,

  • respecting intellectual property rights,

  • providing lawful products,

  • complying with applicable laws and regulations.

Swirls Agency reserves the right to remove listings, suspend vendors, or terminate marketplace accounts that violate our marketplace standards.


13. Policy Changes

Swirls Agency may update this Refund & Returns Policy periodically to reflect changes in our products, services, marketplace operations, or legal requirements.

The updated version will become effective immediately upon publication on this website unless otherwise stated.
